党的二十届三中全会明确提出，要“制定民营经济促进法”。加快制定民营经济促进法，是贯彻落实中央重大决策部署的必然要求。为此，需要紧紧围绕制定民营经济促进法的核心问题，深入探索制定民营经济促进法的实践路径。具体而言，需要从以下五个方面着手：一是要明确民营经济促进法立法的总体思路，坚持党的全面领导，坚持以人民为中心，坚持系统观念，坚持问题导向，加快推进民营经济促进法立法进程；二是要精准把握民营经济促进法的立法定位，将民营经济促进法归入经济法部门，定位为民营经济领域的基本法；三是要准确提炼民营经济促进法的立法理念，坚持促进发展、平等保护、公平竞争、协调发展的基本理念；四是要科学构建民营经济促进法的制度体系；五是要妥善处理民营经济促进法的外部关系。

The Third Plenary Session of the 20th Central Committee of the Communist Party of China explicitly proposed to formulate a law promoting the development of the private economy.Accelerating the establishment of a law to promote private economy is the necessary request to implement the major decision of central leadership. Therefore,it is necessary to deeply explore the practical paths for formulating the law on promoting the private economy by closely focusing on the core issues of its formulation. Specifically,efforts need to be made from the following five aspects:Firstly,it is necessary to clarify the overall thinking of the legislation of the law on promoting the private sectors and accelerate the legislative process,by adhering to the comprehensive leadership of the Party, the people-centered approach, the systematic concept, and the problem-oriented manner. Secondly,it is necessary to accurately grasp the legislative positioning of the law on promoting the private economy,incorporate it into the economic law department,and position it as a basic law in the field of private economy. Thirdly,it is necessary to accurately distill the legislative concepts of the law on promoting the private economy and adhere to the basic concepts of promoting development,equal protection,fair competition,and coordinated development. Fourthly,it is necessary to scientifically construct the institutional system of the law on promoting the private economy. Finally,it is necessary to properly handle the external relations of the law on promoting the private economy.
